Who we are

HeavyShift is operated by Heavy Shift Ltd, a company registered in England and Wales under company number 17344142, with its registered office at 71–75 Shelton Street, Covent Garden, London WC2H 9JQ (“HeavyShift”, “we”, “us” or “our”).

What HeavyShift is — and isn’t

HeavyShift is an online marketplace and directory that helps customers find transport operators and submit transport enquiries, and helps operators promote their services and receive relevant transport opportunities.

HeavyShift is not a haulier, transport operator, broker or agent, and we are not a party to any transport contract between a customer and an operator unless we expressly state otherwise.

Any quote, transport agreement, payment for transport services or dispute relating to transport work is between the customer and the operator.

We do not carry out, supervise or insure transport work and do not guarantee an operator’s availability, suitability, licensing, insurance, conduct, service quality or ability to complete a particular job.

Operators are responsible for determining whether they can lawfully and safely undertake any work offered to them.

Using HeavyShift

Browsing HeavyShift and submitting transport enquiries is free unless we clearly state otherwise.

You must be at least 18 years old to use the service. If you use HeavyShift on behalf of a business, you confirm that you are authorised to act for that business.

You must not:

• submit false, misleading, fraudulent, spam or abusive enquiries;
• impersonate another person or business;
• scrape, harvest or bulk-extract HeavyShift data without our permission;
• attempt to gain unauthorised access to the service or another user's account;
• probe, overload, disrupt or interfere with the operation or security of the service;
• upload unlawful, malicious or infringing content; or
• use HeavyShift for any unlawful purpose.

We may use reasonable technical measures including rate limiting, bot detection and access restrictions to protect HeavyShift and its users.

Transport enquiries

Customers can submit details of items or loads they need transported.

We may use the information provided to identify operators whose services appear relevant to the request and may share the enquiry with those operators for the purpose of obtaining or facilitating a response.

Submitting an enquiry does not guarantee that an operator will respond, provide a quote, be available or accept the work.

Operators remain responsible for assessing each enquiry themselves, including the load, dimensions, weight, access requirements, route, equipment required, legal requirements and any other relevant circumstances.

Quote estimates

Where HeavyShift displays an estimated transport price or price range, it is an indicative automated estimate only.

Estimates may be based on factors such as distance, vehicle type and information supplied by the customer. They may not account for all circumstances affecting the actual cost of the job.

An estimate displayed by HeavyShift is not a quote, offer or binding price.

The actual price and terms of transport are agreed directly between the customer and operator.

Operator listings

HeavyShift contains listings for specialist transport businesses and operators.

Some initial listing information may be compiled from publicly available sources.

We aim to keep listings useful and accurate but do not guarantee that unclaimed listings are complete, current or error-free.

Operators may request that inaccurate information is corrected or that an eligible listing is removed.

Claiming an operator profile

An operator may claim an existing HeavyShift listing to manage its information and access available account features.

When claiming a profile, you confirm that you are authorised to represent the business concerned.

We may require reasonable evidence to verify this before granting control of a listing.

Once a profile is claimed, the operator is responsible for keeping its information accurate and up to date. This includes, where applicable:

• contact information;
• service areas;
• vehicle and equipment information;
• business descriptions;
• images;
• licences;
• insurance information; and
• other information added to the profile.

Operators are responsible for holding all licences, permissions, qualifications and insurance required for the work they undertake.

Operator content

You must not upload content that is false, misleading, unlawful, defamatory or infringes another person's intellectual property or other rights.

You retain ownership of content you upload.

By uploading content to HeavyShift, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and use that content as reasonably necessary to operate and promote your HeavyShift listing and the HeavyShift service.

You can end this licence for future use by removing the content or asking us to remove it, except where we need to retain it for legal, security or record-keeping purposes.

We may edit, hide or remove listings or content where reasonably necessary, including following a valid removal request, breach of these Terms, security concern or legal requirement.

Operator accounts

Operators may create an account to claim and manage their profile and access operator features.

You are responsible for keeping your login credentials secure and for activity carried out through your account.

Please contact us promptly if you believe your account has been accessed without permission.

We may introduce, change or remove account features as HeavyShift develops. Where a change materially affects a paid service, we will provide reasonable notice where appropriate.

Free plan

Claiming and managing a standard HeavyShift operator profile is free.

Features available to Free accounts may include profile management, directory visibility and basic performance information.

Free features may change as HeavyShift develops.

Paid operator plans

Paid operator subscriptions are intended for users acting in the course of a business, trade or profession.

Paid plans may provide features such as matched transport enquiries, enquiry management, quoting tools, enhanced profile functionality, performance information, priority features and other services described on our Pricing page.

The exact features included in each plan are those shown when you subscribe and may develop over time.

Pro

The standard price of Pro is currently £59 per month plus VAT.

Pro is billed monthly in advance and automatically renews each month until cancelled.

Founding Pro

Where offered, Founding Pro costs £29 per month plus VAT for the first 12 months of the subscription.

Founding Pro is a time-limited introductory rate for eligible early HeavyShift operators. It is not a lifetime or permanent discount.

After the 12-month Founding Pro period, the subscription will automatically continue at the standard Pro monthly price then in effect unless you cancel before the next billing date.

We will notify you in advance of the price that will apply after your Founding Pro period.

Billing and payment

Payments for paid subscriptions are processed by Stripe.

By subscribing to a paid plan, you authorise HeavyShift and its payment provider to take the recurring payments disclosed to you at checkout.

Paid subscriptions renew automatically each month until cancelled.

You may cancel at any time. Cancellation takes effect at the end of your current paid billing period, and you will retain your paid features until that date. Your account will then revert to the Free plan unless otherwise stated.

Except where required by law, payments already made are non-refundable and we do not provide partial refunds for unused portions of a billing period.

Price changes

We may change the price of a paid plan from time to time.

We will give affected subscribers reasonable advance notice before a price increase takes effect. Unless we tell you otherwise, the new price will apply from the first billing date after the notice period.

You may cancel your subscription before the new price takes effect.

For Founding Pro subscribers, the £29 monthly introductory rate applies for the stated 12-month introductory period.

No guarantee of results

HeavyShift provides tools intended to help operators promote their services and identify relevant transport opportunities.

We do not guarantee any minimum number or value of profile views, enquiries, leads, quotes, jobs or sales, whether you use a Free or paid plan.

Marketplace activity and operator performance depend on many factors outside our control.

Profile views, enquiry values and other analytics displayed by HeavyShift are provided for informational purposes. They may be estimates and, despite reasonable filtering measures, analytics may occasionally include automated, duplicate or invalid traffic.

Communications

If you create an account, claim a profile, submit an enquiry or purchase a subscription, we may send communications reasonably necessary to provide the service. These may include:

• account and verification emails;
• enquiry confirmations;
• genuine matched-enquiry notifications;
• billing and subscription notices;
• security messages; and
• important service or account updates.

These service communications are separate from promotional marketing communications.

Where we send direct marketing, we will do so in accordance with applicable data protection and electronic marketing law. Where required, we will obtain consent. You can object to or opt out of direct marketing at any time.

Intellectual property

The HeavyShift name, branding, software, site design and compiled directory are owned by Heavy Shift Ltd or our licensors.

Except as permitted by law or with our written permission, you may not copy, reproduce, commercially exploit or redistribute them beyond normal use of the HeavyShift service.

Content uploaded by operators remains subject to the licence described under Operator content above.

Availability of the service

We aim to keep HeavyShift available and operating correctly, but we do not guarantee uninterrupted or error-free access.

We may temporarily restrict or suspend parts of the service for maintenance, security, technical problems or improvements.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

HeavyShift is not responsible for the acts or omissions of independent transport operators or customers, or for loss or damage arising from transport work contracted directly between them, except to the extent that the loss results from something for which HeavyShift is legally responsible.

To the extent permitted by law, HeavyShift will not be liable for indirect or consequential losses or for loss of profit, business, opportunity or data that was not reasonably foreseeable.

For users acting in the course of a business, our total aggregate liability arising out of or relating to HeavyShift or these Terms will, to the extent permitted by law, be limited to the greater of:

• (a) the fees paid by you to HeavyShift during the 12 months immediately preceding the event giving rise to the claim; or
• (b) £100.

Nothing in these Terms affects any rights that cannot lawfully be excluded or restricted.

Suspension and termination

We may suspend or terminate an account or restrict access to HeavyShift where reasonably necessary, including where:

• these Terms have been materially breached;
• fraudulent, abusive or unlawful activity is suspected;
• the service or another user may be at risk;
• payment remains outstanding; or
• we are required to do so by law.

Where reasonably possible, we will give notice before suspending or terminating a paid account unless immediate action is required for security, legal or abuse-prevention reasons.

You may stop using HeavyShift at any time.

If you have a paid subscription, you must cancel it to stop future subscription renewals.

Changes to these Terms

We may update these Terms as HeavyShift develops or where changes are needed for legal, regulatory, security or operational reasons.

If a change materially affects an existing paid subscription, we will provide reasonable notice before it takes effect where appropriate.

The date at the top of this page shows when these Terms were last updated.

Governing law

These Terms are governed by the laws of England and Wales.

If you use HeavyShift as a business, the courts of England and Wales will have exclusive jurisdiction over disputes relating to these Terms.

If you use HeavyShift as a consumer, you retain any rights you have under applicable law regarding where proceedings may be brought.
